1. Who we are
PhilRoom (“PhilRoom”, “we”, “us”) is operated by Twinkle Moron Elpanag, a sole proprietor based in Metro Manila, Philippines. Our business registration is in process. The registered business name, address and registration number will be published on this page once issued. You can reach us at privacy@philroom.ph.
2. What these terms cover
These Terms of Use govern your use of philroom.ph and everything we publish on it (the “Service”). By using the Service, you accept them. If you do not accept them, please do not use the Service.
Our salespersons and brokers sign a separate written undertaking before they are given access to our working screens, and some of them also sign a service agreement. Those documents bind them in addition to these terms. Where they are stricter, the stricter rule applies to them.
3. What we do — and what we are not
- We publish rental and for-sale listings, confirm them with the person who posted them, and put you in touch with the owner or with a PhilRoom salesperson.
- Any act that constitutes a real estate service under RA 9646 (the Real Estate Service Act) is performed only by a PRC-licensed real estate broker, or by a salesperson accredited under and supervised by that broker.
- We are not a party to your lease or sale contract. That contract is between you and the owner or seller. We do not own, manage, or control any property listed on the Service.
- We are not your lawyer, and nothing here is legal or tax advice.
4. What it costs
- For tenants, searching, asking, viewing and being introduced to a listing is free. We are paid by the owner’s side when a transaction closes.
- Owners can list a place for rent at no charge.
- Paid products for licensed professionals — for example advertising a pre-selling or resale unit — are governed by the price and conditions shown to you when you sign up for them, in addition to these terms.
5. Your account
- You must be at least 18 years old to hold an account.
- Give us information that is true, and keep it current. We act on what you tell us — a wrong number means a salesperson calls the wrong person.
- One person, one account. Do not share your password, and tell us at privacy@philroom.ph if you think someone else is using your account.
- Staff, salesperson, broker and administrator roles are granted by us. They cannot be obtained by signing up, and they are removed when the working relationship ends.
6. Listings, and what the person posting them promises
By posting a listing, or by giving us the details for us to post it, you confirm that:
- you own the property or are authorised by the owner to offer it;
- the price, deposit, advance, terms and the unit itself are accurate on the day you give them to us;
- the photos and videos are of the actual unit, and you have the right to let us publish them;
- the unit is available, and you will tell us as soon as it is taken.
Bait pricing, units that do not exist, and re-posting a unit that is already taken are grounds for removing the listing and closing the account.
We call to confirm listings and we may visit them, but we do not guarantee that a listing is accurate or still available. We may edit, translate, unpublish or remove any listing at any time.
7. Photos and text you upload
You keep ownership of what you upload. You give us a non-exclusive, worldwide, royalty-free licence to store, resize, translate and display it on the Service and in our own promotion of that listing, for as long as the listing is published and for a reasonable period afterwards in our records. You confirm you have the right to give us that licence. Do not upload photos taken from other websites or from other people’s advertisements.
8. Money — please read this one
PhilRoom does not collect deposits, advances, rent, reservation fees or “processing fees” from tenants. Nobody working with us — staff, salesperson or broker — is allowed to receive your money, whether in cash, by GCash, or by bank transfer. This is written into the undertaking every one of them signs.
If anyone asks you to send money in our name, do not send it, and tell us at privacy@philroom.ph. Payment belongs between you and the owner, at the signing.
9. Messages and machine translation
Inquiries are translated automatically so that both sides can read them. Machine translation is often imperfect. The original message controls, and you should not rely on a translated sentence for the terms of a contract — price, deposit, dates and condition belong in the written lease.
When you send an inquiry, your name and contact number are given to the salesperson handling that listing and, where needed to answer you, to the owner. What we do with the rest is in the Privacy Notice.
10. Things you must not do
- Pretend to be PhilRoom, or to be one of our staff, salespersons or brokers.
- Collect listings, photos or contact numbers in bulk by automated means, or get around rate limits and other protections.
- Use contact details found on the Service to solicit for a competing service.
- Post other people’s personal information without their consent.
- Harass, threaten or discriminate against anyone, including our staff.
- Upload anything harmful to the Service, or use it for anything unlawful under Philippine law.
11. Suspending and closing accounts
You may stop using the Service at any time and ask us to delete your account — the Privacy Notice explains what we can and cannot delete. We may suspend or close an account, remove content, or refuse service where these terms are breached, where we reasonably suspect a fake listing or fraud, or where the law requires it. For people who work with us, how the relationship ends is governed by their undertaking and service agreement.
12. The Service is provided as it is
We are an early-stage service and features change. We do not promise that the Service will be uninterrupted or error-free, and we may change or withdraw parts of it. Listing information comes from owners and from public advertisements. We confirm what we can, and we do not warrant that a property, its owner, or its documents are what they appear to be. Check the unit and the owner’s authority before you pay anything.
13. Our liability
To the fullest extent Philippine law allows, we are not liable for indirect or consequential loss, or for loss caused by an owner, a tenant, or a third party acting outside our instructions. Our total liability to you for any claim connected to the Service is limited to what you paid us in the twelve (12) months before the claim, and to ₱5,000 where you paid us nothing.
Nothing here limits our liability for fraud, bad faith, gross negligence, death or personal injury, or for anything the law does not allow us to limit (Civil Code, Arts. 1170–1171).
14. Changes to these terms
We may update these terms. The version number and effective date at the top of this page change with it, and we will say so on the site when the change is material. Continuing to use the Service after the effective date means you accept the new version.
15. Language
These terms are written in English and the English text is the official one. Any translation we publish is for convenience only.
16. Governing law
These terms are governed by the laws of the Republic of the Philippines. Disputes are submitted to the proper courts of Metro Manila, without prejudice to any right you have under Philippine consumer law to file elsewhere.
